Power of attorney basics in Florida

A power of attorney allows a person to choose another individual to act on their behalf. A power of attorney may apply only to certain aspects of life such as medical decisions or selling a home but is also able to cover all aspects of decisions if the person who is grating the power becomes incapacitated. Establishing power of attorney may be one part of ensuring that life decisions are managed as planned.

When establishing a power of attorney, an individual should select someone who embodies the integrity needed to make the decisions that would be made by the grantor. Once a POA is established it remains in effect regardless of relocation or life changes such as divorce or other circumstance until it is legally revoked. The revocation can be due to a new POA, which requires a written document, or because the individual is again able to act independently.

Without a document to ensure that the person selected is legally designated to act on an individual's behalf, the courts will make a decision and select someone to represent a person's interests. A verbal agreement with someone will not be legally recognized. Specifying the decisions the person can make is critical in order to prevent any conflict of interest.

Reviewing a POA periodically, particularly during times of major life changes, may be important to maintaining relevant documentation that could be influential to a person's estate. Most people need help at some point during their lifetimes, and a POA may be able to provide a grantor with peace of mind. An attorney may be able to help by explaining the details of a POA and could provide guidance during the selection of the person to serve as attorney-in-fact.
