How to write a will in Florida

One way to exert more control over how assets are distributed is to write a will. However, it is important that the will is written correctly. Otherwise, it may be left vulnerable to legal challenges. For example, an individual must be over the age of 18 and clearly state that the document is meant to act as a legal document.

Furthermore, the person who writes the will must be in a sound state of mind when it is written. While it is not necessary to notarize it, this may act as a way to improve the odds that the document is accepted as legitimate. An executor of the estate must be named, and this person must be over 18 and have no prior felony convictions. As long as these two requirements are met, anyone can be the executor who is responsible for paying taxes and protecting the best interests of the deceased.

If an individual is asked to be an executor but refuses to do so, they must file a formal notice that they have chosen to do so. In addition to choosing an executor, beneficiaries to certain assets may also need to be named. Secondary beneficiaries may be named in the event that the primary beneficiary passes away or is otherwise unable to accept a distribution from the estate.
